The Supreme Court has agreed to hear a series of petitions on Tuesday concerning allegations of excessive force used by law enforcement personnel against students demonstrating across the country over the NEET paper leak and general examination irregularities.
A bench comprising Chief Justice Surya Kant, Justice Joymalya Bagchi, and Justice V Mohana will take up the matters. The apex court also agreed to hear a related plea submitted by family members of police personnel who sustained injuries during the protest demonstrations.
Right To Agitation And Police Restraint
While taking up the petitions, the bench emphasized that the right to engage in peaceful demonstrations is a guaranteed constitutional right that cannot be denied. The court observed that the existence of a public agitation does not provide law enforcement with grounds to engage in excessive measures against demonstrators.
Protection For Security Personnel And Citizens
Responding to submissions by a legal representative highlighting instances where police personnel were assaulted during the agitation, the bench remarked that every individual’s life holds equal value, regardless of their position.
Demand For Uniform Nationwide Protocol
Addressing the broader context of managing public demonstrations, the court highlighted the necessity of establishing a standardized protocol across the country rather than limiting guidelines to the national capital. The bench indicated that a comprehensive policy should guarantee designated spaces for peaceful gatherings without arbitrary restrictions while simultaneously outlining measures to manage anti-social elements.
