The Supreme Court on Wednesday issued notice to cricketer Mohammed Shami on petitions filed by his estranged wife seeking transfer of multiple proceedings, including a domestic violence case, from West Bengal to Delhi. The matter will be taken up after four weeks.
A bench of Justices Manoj Misra and Manmohan agreed to hear two separate transfer petitions moved by Shami’s wife through advocate Deepak Prakash and sought responses from the respondents, including the cricketer.
The petitions seek transfer of pending cases from courts in West Bengal to Delhi. One of the matters sought to be transferred pertains to proceedings arising out of allegations of domestic violence.
The court issued notice on the transfer petitions and granted four weeks’ time for filing replies.
The top court had earlier, on November 7 last year, issued notice to Shami on a separate plea filed by his estranged wife seeking enhancement of interim maintenance granted to her and their minor daughter.
In that petition, she has challenged two orders of the Calcutta High Court dated July 1 and August 25, by which the interim maintenance payable by Shami was fixed at ₹1.5 lakh per month for his wife and ₹2.5 lakh per month for their daughter. The High Court had also permitted the cricketer to clear the arrears in eight monthly instalments.
In 2018, an FIR was registered against Shami at Jadavpur Police Station in Kolkata on allegations of domestic violence. A chargesheet was subsequently filed in the case.
Following this, his estranged wife also initiated proceedings under the Protection of Women from Domestic Violence Act seeking interim maintenance.
The transfer petitions will now be heard after four weeks, following receipt of Shami’s response.
