Employee Can’t be Terminated on the Ground of Financial Constraint due to COVID Pandemic: HC

In a recent case, the Delhi High Court observed that the State or its instrumentalities Article 12 of the Indian Constitution couldn’t claim constraints or impact of the pandemic as a ground for dispensing the services of its employees. This observation was made by the Court while quashing Air India’s decision to terminate its pilots.
