The Delhi Police has urged the Supreme Court to dismiss the bail application of Bibhav Kumar, accused of the alleged brutal assault on AAP Rajya Sabha MP Swati Maliwal. The incident reportedly occurred at Delhi Chief Minister Arvind Kejriwal’s residence, intensifying the scrutiny of the case.
In their affidavit, the police described the assault on Maliwal as severe, highlighting the sensitivity of the location— the Chief Minister’s official residence—and the profile of the accused, an influential former officer and aide to CM Kejriwal. The case has captured public attention, raising concerns about the safety and treatment of public officials.
Deputy Commissioner of Police Manoj Kumar Meena, in the filed affidavit, emphasized the impact of the incident on the public and the potential repercussions of the court’s decision. “This case pertains to a brutal assault on a sitting Member of Parliament in a highly sensitive location, which has greatly disturbed the general public,” the affidavit stated.*
Kumar, who has been in judicial custody since his arrest on May 18 following the incident on May 13, had his bail plea previously rejected by the Delhi High Court on July 12. The High Court cited Kumar’s considerable influence and the risk of witness tampering or evidence manipulation as reasons for the denial.
The police affidavit further highlighted the psychological and physical toll on Maliwal, noting her confinement at home for days due to trauma. It also insisted on Maliwal’s participation in the bail hearings, asserting that any decision affecting Kumar’s liberty could directly impact her safety and wellbeing.
The case is currently before a bench led by Justice Surya Kant, who has already made significant observations regarding the gravity of the allegations and the conduct of the accused.
