Allahabad High Court Issues Arrest Warrant Against District Magistrate for Non-Compliance

In a significant ruling, the Allahabad High Court issued an arrest warrant against the District Magistrate (DM) of Banda, Uttar Pradesh, for failing to comply with its order concerning salary increments for retired employees. The Court’s directive, which was supposed to benefit the retirees with a pay increase effective from July 1 following their retirement on June 30, has not been implemented.

The original order, issued on June 30, 2023, came after a petition by Ramesh Kumar Shrivastav and 16 other government employees, who retired on June 30 in various years between 2012 and 2023. They sought to secure the annual increment they were due on July 1, which was traditionally granted to serving employees. However, the concerned department denied the increment, asserting that the retirees were not in service on the effective increment date, which was a day after their retirement.

The petitioners challenged this decision in the High Court, which ruled in favor of granting the increment. Despite the court’s clear instructions, the implementation was not carried out by the district authorities under the DM of Banda, prompting the issuance of an arrest warrant.

Justice J.J. Munir, overseeing the case, instructed the DM, Nagendra Pratap, to submit a personal bond of INR 20,000 to the Chief Judicial Magistrate of Banda and present a sworn affidavit committing to appear in court on July 25 at 2 PM. Attempts to reach DM Nagendra Pratap for comments were unsuccessful.
