In a significant legal victory for Delhi Chief Minister Arvind Kejriwal, the Delhi High Court has dismissed another petition demanding his removal from the position of Chief Minister. The petition, which cited Kejriwal’s arrest in connection with a money laundering case related to the Delhi excise policy scam, was turned down by the court, allowing Kejriwal to continue in his role as Chief Minister.
The plea, filed by Vishnu Gupta, president of the Hindu Sena organization, was reviewed by a bench comprising Acting Chief Justice Manmohan and Justice Manmeet Preetam Singh Arora. During the proceedings, the court remarked that it is often necessary to subordinate personal interests to national interests. However, the bench clarified that the decision to remain in office rests solely with Kejriwal himself, subtly hinting at the need for personal discretion in matters of public service.
Despite the legal challenges faced, the court emphasized that it does not have the jurisdiction to decide on the matter, stating that the decision lies with the Lieutenant Governor (LG) of Delhi or the President of India. The court further remarked that the LG is expected to act in accordance with the law without requiring judicial guidance.
Vishnu Gupta, the petitioner, expressed his intention to withdraw the plea and indicated plans to approach the Lieutenant Governor with his appeal.
