Recently, the Madhya Pradesh High Court stated that surrendering of an accused is not necessary before preferring a criminal revision application under Section 397 CrPC. The bench of Justice Vishal Dhagat was dealing with the application challenging the judgment passed by the Additional Sessions Judge by which the sentence of the applicant has been enhanced.
