Big change in UPHJS – Lawyers who do not have active practice will not be eligible

There has been a big change in the UPHJS process of recruitment of judicial officers in Uttar Pradesh.

For this, a provision has been made in the Uttar Pradesh Higher Judicial Service (Sixteenth Amendment) Rules-2023.

Before the amendment, minimum seven years of experience as an advocate was required for higher judicial service, but now with the new amendment alongwith seven years of experience, candidate must have been engaged independently for conducting not less than 30 cases (other than bunch cases) for Unreserved categories and 24 cases (other than bunch cases) for Scheduled Castes, Scheduled Tribes and Other Backward Classes in the preceding three years, from the year of publication of advertisement

Rule 5 – Source of Recruitment – Recruitment to the service will be done in the following manner: – (c) By direct recruitment from among the advocates practicing as an advocate for a minimum of seven years as on the last date fixed for submission of applications. ;

Provided that only such advocates shall be permitted to appear in the examination process who have been engaged independently for conducting not less than 30 cases (other than bunch cases) for Unreserved categories and 24 cases (other than bunch cases) for Scheduled Castes, Scheduled Tribes and Other Backward Classes in the preceding three years, from the year of publication of advertisement for recruitment, before any Court. The certificate of such independent engagement may be issued by District & Sessions Judge of the District or Registrar General/ Registrar of High Courts or Secretary General of Supreme Court, as the case may be

With this amendment the number of posts has also been increased to 1340. There are 799 permanent and 541 temporary candidates, which earlier was 150.

Under this rule, recruitment of District and Sessions Judge, Additional District and Sessions Judge (special courts created from time to time for specific cases like commercial disputes, land acquisition, motor accident claims, petitions etc.) is done.

Now two-tier preliminary and main examination will be conducted for recruitment. If the number of applications for recruitment is 10 times more than the number of vacancies, a preliminary examination will be conducted first to assess the eligibility of the candidates.

This exam will be of two hours and 100 marks. Only those who score 45 percent marks in the preliminary examination will be considered eligible for the main examination. Those who pass the written examination will be considered eligible for interview.
