Recently, the Bombay High Court has quashed an FIR lodged by a wife against her husband alleging that their married life was severely affected by stress of work in the early days of Covid-19 pandemic.
The FIR was quashed after taking consent of both the parties.
The Bench expressed their happiness that the couple sorted out their differences and decided to move on.
After the lawyer informed the Bench about the decision of the couple, the Judges themselves talked to the wife through video conferencing and were satisfied by the wife’s decision to take back the complaint.
The Bench also expressed their desire to talk to the husband, but the wife informed the Court that her husband worked in a government hospital and was unavailable.
In her statement, the wife stated that she and her husband were working up to 19 hours a day drawing the initial days of the pandemic due to which there was a misunderstanding between her and her husband and she filed a domestic violence case against the husband.
The wife, who is a microbiologist stated that she was married for over 20 years and had two children as well. When the Court asked her if it was her decision to settle the case, she replied in the affirmative and informed the Court that she moved back with the husband and the kids back in September.
Hon’ble Justice Shinde who was also part of the Bench, referred to a friend of his who also worked in a government hospital and reflected how stressed people were during the pandemic, especially doctors. He also expressed that the Court greatly respected all the doctors and their work during the pandemic.
Hon’ble Court told the parties and their lawyers that they were ready to quash the FIR and wished the couple good luck.
