Recently, the Allahabad High Court has directed the Registrar General of the Court to file a complaint against the boy (Petitioner No.2) before the competent court for filing forged and fabricated documents to prove his date of birth.
Why Allahabad HC has Directed its Registrar to File Complaint Against a Petitioner?
Petitioner No 1 (Anushka Dwived) a major girl aged about 19 years eloped with Petitioner No.1 Boy (Vipin Kumar), whose date of birth as per the Certificate filed alongwith the Writ Petition was 10.02.1999.
The Complainant produced another certificate of Petitioner No.2 boy before the Court in which the date of birth was 10.02.2002.
At this the Court directed the counsel for CBSE Board to produce the gazette for determining the correct Date of Birth of Petitioner No.2.
On the next date the Counsel for the CBSE produced the record and as per the record the date of birth of Petitioner No.2 is 10.02.2002 not 10.02.1999, as such the certificate filed along with the Writ Petition was forged and fabricated.
Allahabad HC Directs Registrar General to File Complaint
A Bench of Hon’ble Justice Ramesh Sinha and Hon’ble Justice Samit Gopal after perusing the record observed that as per the record of CBSE the Petitioner No.2 is 18 years of age therefore not of marriageable age. As such the document filed along with the Writ petition is forged and manipulated.
In view of the above the Court dismissed the Writ Petition, however before parting with the Order the Court has directed the Registrar General of the High Court to file a complaint against the Petitioner No.2 boy before the competent court for filing forged and fabricated document before the Court.
