When there is voluntary sexual union there is no reason to indict the male-only

The Calcutta High Court has ruled that a voluntary joint act of sexual union would not attract the offense under the POCSO (Protection of Children from Sexual Offences) Act. A Single Judge Bench of Justice Sabyasachi Bhattacharya observed that if the sexual union was participatory in nature, then there was no reason to indict male-only
