Uttarakhand High Court Rejects Bail for Mother Accused of Forcing 13-Year-Old Daughter into Sexual Exploitation

The Uttarakhand High Court has denied bail to a woman accused of orchestrating the sexual exploitation of her 13-year-old daughter. In a ruling delivered on Thursday, Justice Alok Mehra’s single bench cited the “severity of the allegations” and the potential psychological and physical impact on the minor victim as primary grounds for refusing the woman’s release.

The case originated in Haridwar, where the victim’s father filed a formal complaint. The prosecution presented a disturbing narrative, alleging that the mother forced her minor daughter to consume alcohol before transporting her to various cities across Northern India for the purpose of establishing physical relationships with a co-accused.

According to court records, the exploitation allegedly occurred in multiple locations, including Haridwar, Agra, Ghaziabad, and Vrindavan.

During the proceedings, the defense sought relief for the accused by highlighting what they termed significant inconsistencies in the prosecution’s story. They argued that the victim was enrolled in a residential school during the period in question and pointed to a five-month delay in the filing of the First Information Report (FIR).

The defense further noted that the woman has been in custody since June 2025, suggesting that the duration of her incarceration should weigh in favor of her release.

However, the state government strongly opposed the bail application, emphasizing the gravity of the mother’s alleged betrayal of her parental role and the safety of the minor.

Justice Mehra dismissed the defense’s arguments regarding the timeline and school enrollment, clarifying that such factual inconsistencies or delays are matters to be adjudicated by the trial court during the full examination of evidence, rather than during a bail hearing.

The court specifically observed that the length of time already served in jail cannot be used as a justification for bail in cases of such a serious nature. Furthermore, the bench expressed concern that if the accused were released, there would be a significant risk of witness tampering or influence, particularly given the familial relationship involved.

The mother remains in custody as the legal proceedings continue in the lower trial court.
