Unsuccessful Surgery Alone Does Not Prove Medical Negligence: Punjab and Haryana High Court

In a significant judgment, the Punjab and Haryana High Court clarified the law surrounding medical negligence, ruling that the failure of a sterilization procedure, by itself, does not constitute medical negligence. Justice Anil Kshetarpal, presiding over the matter in RSA-4214-2002 (O&M), reversed an appellate court’s decision that had awarded compensation based on presumed negligence. Background
