The Supreme Court of India has issued a stay on the controversial ruling of the Allahabad High Court regarding an assault on a minor. The Allahabad High Court had previously ruled that the act of grabbing the breasts of a minor, along with other aggressive actions, did not amount to an attempt to rape.
This decision was met with widespread criticism, prompting the Supreme Court to intervene. The Bench, comprising Justices BR Gavai and Augustine George Masih, highlighted the lack of sensitivity in the High Court’s judgment. The Supreme Court criticized the High Court for its “inhuman approach” and promptly stayed the objectionable paragraphs of the judgment.
The case, which has sparked significant legal and public discourse, originated from an incident involving two men, Pawan and Akash, who were accused of assaulting an 11-year-old girl. The High Court had reduced their charges, leading to public outcry and the eventual Supreme Court review.

In response to the Supreme Court’s stay, notices have been issued to both the Central and Uttar Pradesh governments, with the Court seeking assistance from the Attorney General and Solicitor General in addressing the matter comprehensively.
