In a protracted legal battle culminating after 11 years, the Consumer Protection Court in Patna has ordered a well-known local hospital to compensate a patient with Rs 40 lakh for alleged medical negligence. The former patient, Ramesh Kumar Yadav from Gopalganj, claimed his prospects of employment abroad were derailed due to multiple failed surgeries.
Justice Prem Ranjan Mishra, alongside member Rajneesh Kumar, delivered the verdict against the managing director of the hospital following a series of botched medical procedures that reportedly left Yadav in continuous pain and with medical complications. The dispute began when Yadav prepared to move to Dubai for work in 2012 but started experiencing severe abdominal pain. An initial diagnosis at the Patna hospital revealed kidney stones, which led to his first surgery at the clinic.
However, complications from the surgery necessitated further operations in February 2013 and later in the same year, with Yadav alleging that surgical tools had been mistakenly left inside his body, leading to persistent pain and additional medical procedures.
Yadav contended that the hospital’s negligence not only caused him physical suffering but also financial losses, including the job opportunity in Dubai for which he had already secured a visa. The Consumer Protection Court took note of these grievances and appointed a medical board headed by the Civil Surgeon to investigate the claims, which found the hospital’s procedures lacking and justified the compensation.
The accused doctor and the hospital’s managing director did not appear before the board when summoned, and reportedly have not been informed of the court’s decision yet. The hospital’s management has stated they will follow the legal process once they officially receive the court order.
