Patna High Court Delivers Verdict on New Teacher Regulation, Addresses Competency Examination

In a significant ruling, the Patna High Court has pronounced its verdict on the petition challenging the new regulations for the appointment of teachers in Bihar, known as the Bihar Teacher Bharti. The High Court granted partial approval to the contested regulations.

The bench, comprising Chief Justice K. Vinod Chandran and Justice Harish Kumar, addressed the petitions filed by Pramod Kumar Yadav and others, focusing on four main aspects of the new teacher regulation.

Validation of Competency Examination for Local Body Teachers:

The High Court upheld the requirement for a competency examination (Sakshamta Pariksha) for teachers employed by local bodies within the state, affirming the examination’s legitimacy.

Annulment of Rule 4 in the New Teacher Manual:

Rule 4 of the New Teacher Manual, which mandated all teachers to pass the competency examination, was nullified by the High Court, relieving teachers from this compulsory requirement.

Revocation of Rule 12 from Bihar State Educational Institutional Teachers and Employees (Grievance Redressal and Appeal Regulations) 2020:

The High Court also annulled Rule 12, which stipulated that pending cases/issues before the district/state appellate authority should be resolved within six months of the regulations’ approval date. Furthermore, it prohibited the district/state appellate authority from accepting new cases thereafter.
