Parents Legally Obligated to Provide Educational Support to Daughter: Supreme Court

In a pivotal decision, the Supreme Court of India has declared that daughters possess an “indefeasible, legally enforceable and legitimate right” to demand educational expenses from their parents. This ruling emerged from a matrimonial dispute involving a couple and their daughter who is currently studying in Ireland. The bench, comprising Justices Surya Kant and Ujjal Bhuyan, emphasized that parents can be legally compelled to provide necessary funds for their daughter’s education, within their financial means.

During the proceedings, it was revealed that the daughter had refused to accept Rs 43 lakh offered by her father as part of her educational expenses, which was included in the total alimony being paid to her mother. The refusal was based on her wish to maintain her dignity, prompting her to request the return of the funds, which her father denied.

The court noted that the father had spent money without any compelling reasons, suggesting he was financially capable of supporting his daughter’s academic needs. This decision underscores the importance of educational rights and the responsibilities parents hold towards ensuring their children can pursue their educational aspirations without financial hindrances.
