No Application U/s 156(3) Should be Entertained Unless Accompanied With an Affidavit, Rules Supreme Court

The Supreme Court has ruled that a Magistrate cannot hear an application under Section 156 (3) of the Code of Criminal Procedure if the complaint is not accompanied by an affidavit. With such a requirement, people would be discouraged from invoking the Magistrate’s authority in the first place, as provided for in Section 156 (3)
