Magistrate Can Discharge the Accused Even Before any evidence is Recorded under Section 244 (1) CrPC, Rules Allahabad HC

The Allahabad High Court at Lucknow has held that Magistrate can discharge the accused at any previous stage i.e. even before any evidence is recorded under Section 244 (1) Cr.P.C. Justice Rajesh Singh Chauhan has passed the Judgment in a Petition filed under Section 482 CrpC challenging the order of Magistrate rejecting the discharge application
