MACT Thane Awards ₹19.83 Lakh Compensation to Family of Pedestrian Killed in 2018 Motorcycle Accident

The Motor Accident Claims Tribunal (MACT) in Thane has awarded compensation of ₹19.83 lakh to the family of a 46-year-old pedestrian who died after being hit by a speeding motorcycle in Bhiwandi in 2018.

MACT member K.P. Shrikhande directed the owner of the offending vehicle to pay the compensation with interest at 9 per cent per annum from August 26, 2024, until full realisation. The amount is to be paid to the deceased’s widow, Aleja Begum Badaruddin Choudhary, and their three children.

Badruddin Kalaraj Choudhary, a native of Assam, was walking home near Indian Compound in Bhiwandi on February 4, 2018, when a motorcycle allegedly being driven at high speed hit him. He sustained severe injuries and succumbed to them the following day.

The tribunal noted that the FIR recorded that the motorcycle was being driven in a “rash or negligent” manner.

For the purpose of computing compensation, the tribunal assessed Choudhary’s monthly income at ₹12,000. He was employed at a cake shop at the time of the accident. The claimants had sought compensation of ₹50 lakh.

Based on the assessment, the tribunal determined the total compensation at ₹19.83 lakh.

The tribunal directed that:

  • 40 per cent of the compensation be paid to the widow
  • 20 per cent each be paid to the three children, aged between 7 and 19 years

The compensation will carry interest at 9 per cent per annum from August 26, 2024, until the amount is fully paid.
