In a poignant decision, the Kerala High Court granted bail to a 25-year-old man accused of assaulting his mother with a knife after she refused to give him money for New Year’s Eve celebrations. The bail was granted following the mother’s heartfelt plea, highlighting her inability to see her son remain in custody.
Justice P V Kunhikrishnan, who presided over the case, expressed his distress over the incident, which he described as both “astonishing and disturbing,” reflecting on the deteriorating mental condition of the country’s youth. Despite the severity of the accusations — involving grievous hurt and attempted murder under the Bharatiya Nyaya Sanhita — the judge was moved by the mother’s forgiveness and unconditional love.
The court was compelled to grant bail after reading an affidavit from the mother, who stated that she harbored no objection to her son’s release. “I am sure that the wounds on her body might not have healed, but her love for her son takes over the wounds,” Justice Kunhikrishnan remarked, drawing an analogy to a rose’s perennial bloom to describe a mother’s enduring love.

The conditions of the bail include a bond of Rs 50,000 with two solvent sureties for a similar amount, mandatory weekly appearances before the investigating officer, and strict orders not to intimidate witnesses or leave the country without court permission. The court emphasized the role of society and parents in monitoring the youth and ensuring they maintain relationships with good influences.
Furthermore, the High Court has allowed for immediate legal action if the accused engages in any criminal activity post-release. The mother retains the right to report any such behavior to the jurisdictional police station, which could lead to a potential bail cancellation.
