Karnataka HC Addresses Prajwal Revanna’s Request for Digital Evidence Amid Rape Allegations

In a recent hearing, the Karnataka High Court deliberated on suspended Janata Dal (Secular) leader Prajwal Revanna’s request for access to digital evidence in connection with multiple allegations of rape, sexual assault, and criminal intimidation against him. Justice M. Nagaprasanna emphasized that while the court is inclined to ensure fair trial rights by allowing Revanna access to evidence, it will strictly prohibit the disclosure of any details that could potentially identify the victims, with the exception of the complainant in the ongoing case.

During the proceedings, Additional Special Public Prosecutor BN Jagadeesha contended that Revanna’s petition to access over 17,000 digital files, including images and videos from a Samsung phone reportedly belonging to his driver, was a strategic move to delay the legal process. The prosecution asserts that these files contain sensitive information about other victims which, if disclosed, could jeopardize their privacy and safety.

Justice Nagaprasanna directed the State Special Investigation Team (SIT) to provide Revanna with any remaining pertinent evidence, adhering to guidelines established by the Supreme Court in the case of P. Gopalakrishnan vs. the State of Kerala. He stated, “Under Section 207, you will have to give him copies… We will not permit anyone to reveal the identity of others (victims) or endanger them in any way.”

The court has scheduled further arguments for January 16, ensuring that the proceedings continue without compromising the safety and confidentiality of the individuals involved. Meanwhile, the trial court is set to proceed with the preliminary hearing but has been instructed to hold off on framing charges until the High Court resolves the matter at hand.
