Justice Surya Kant Advocates for Arbitration as the Preferred Mode of Dispute Resolution in India

At the valedictory function of a conference on international arbitration and the rule of law, Supreme Court Justice Surya Kant emphasized India’s robust commitment to arbitration, marking it as the increasingly favored method for dispute resolution within the country. The conference also celebrated the 75th anniversary of the Supreme Court and the 125th anniversary of the Permanent Court of Arbitration (PCA).

“India is poised at the beginning of a new era in arbitration. This method is not only becoming a preferred mode of dispute settlement domestically but also enjoys growing infrastructural support,” Justice Kant remarked on Sunday.

Highlighting India’s longstanding dedication to international arbitration frameworks, Justice Kant noted, “India was one of the six Asian nations to sign the Geneva Convention and among the ten original signatories to the New York Convention.” This historical commitment underscores India’s reliable adherence to enforcing foreign arbitral awards, bolstering its position in the international arbitration arena.

The event took on additional significance with the announcement that the PCA will establish an office in India, a development Justice Kant described as a “paradigm shift” that furthers India’s aspirations to become a global hub for international arbitration.

Reflecting on India’s rich history, Justice Kant pointed out that arbitration is deeply embedded in the subcontinent’s cultural and historical tapestry, with numerous references throughout its past. This tradition underpins the modern move towards arbitration, bridging ancient dispute resolution practices with contemporary needs.
