In the latest Order of Allahabad High Court , a Division Bench comprising Hon’ble Mr. Chief Justice Govind Mathur and Hon’ble Mr. Justice Siddhartha Varma, has declined to interfere in a Public Interest Litigation seeking direction to allow the organization of Durga Puja.
In the last week of September, the State Government issued orders that in view of the surge in COVID-19 Pandemic cases, this year Durga Pooja Pandals shall not be allowed. Read Here
A Public Interest Litigation was filed before the Allahabad High Court by Pranob Kumar Roy and another. By means of the aforesaid PIL, following prayers, were sought:
- Issue writ order or direction of in the nature of mandamus directing the respondent no.1, 2 and 3 to permit the Durga Puja Barwaris/ Committee’ to organise the ‘Durga Puja’ in the city of Prayagraj under the guidelines laid by the Central/State/District Administration on the eve of COVID-19.
- Issue writ order or direction of in the nature of mandamus directing the district and police administration to call a meeting to office bearers of Bengali Welfare Association as well ‘Durga Puja Committee’ prior at least 21 days before taking any decision, in this regard for the appraisal of their difficulties of both.
The Allahabad High Court after hearing the parties was of the considered opinion that to permit the Durga Puja or any other social and religious event is subject to guidelines prescribed by the Government of Uttar Pradesh to combat the COVID-19 pandemic.
Ultimately the Court disposed off the PIL with the direction that the petitioners may agitate their cause before the District Magistrate, Prayagraj who will consider the cause in accordance with law and by taking into consideration the necessary guidelines given by the Government of Uttar Pradesh.
