Highly dramatic scenes unfolded inside the Supreme Court on Friday when a petitioner appearing in person disrupted formal proceedings, hurled verbal abuse at the Chief Justice of India, and threw legal documents across the courtroom. Despite the extreme nature of the disruption, the presiding bench chose to dismiss the petition solely on its legal merits while responding to the individual’s outburst with empathy rather than initiating contempt of court proceedings.
The incident occurred during a hearing before a bench consisting of Justice KV Viswanathan and Justice Alok Aradhe, who were reviewing a Special Leave Petition challenging a prior decision of the Allahabad High Court.
Aggressive Demands and Courtroom Escalation
The atmosphere in the courtroom turned tense when the petitioner, representing himself, adopted an unusually hostile and commanding stance during his submissions. He demanded that the judges issue an order directing the registration of a First Information Report (FIR) against an Assistant Commissioner of Police (ACP) in Lucknow.
Justice Viswanathan immediately challenged this aggressive approach, asking the litigant if he was attempting to dictate orders to the bench. The petitioner answered that everything required was already on the record and indicated that he had concluded his remarks.
Shortly after this exchange, the situation escalated rapidly. The litigant threw his legal papers into the air and began using abusive language directed at the Chief Justice of India. Security personnel inside the courtroom acted quickly to intervene, securing the man and escorting him out of the premises.
Bench Declines Contempt Action
While courtroom disruptions of this scale often trigger immediate punitive action or contempt charges, the bench decided against taking any legal recourse against the litigant.
Addressing the incident, Justice Viswanathan stated that they did not intend to pursue any action against the individual. Instead, the bench focused strictly on the legal aspects of the case, noting that a thorough review of the records revealed no valid grounds to overturn the impugned order of the lower court, resulting in the official dismissal of the Special Leave Petition.
An Empathetic Response to Frustration
In the aftermath of the disruption, senior advocate P.S. Patwalia remarked on the incident, noting that while the role of a judge is notoriously difficult, there are certain days when those challenges become incredibly visible to the public.
In response, Justice Viswanathan offered a compassionate perspective on the litigant’s behavior. He explained that the petitioner appeared to be deeply disturbed and that his actions were driven entirely by personal frustration, concluding that the bench felt nothing but sympathy for his difficult situation.
