Gujarat HC Imposes ₹25,000 Fine on Woman for Posting Ex-Roommate’s Bathroom Photo on Instagram

In a recent ruling, the Gujarat High Court has fined a young woman ₹25,000 for creating a fake social media account and posting unauthorized photos of her former hostel roommate. The court found that the woman had engaged in this act out of vengeance to disrupt her ex-roommate’s engagement.

The incident, which dates back to March 2021, came to light when the victim’s engagement was announced. Following the engagement, her roommate created an Instagram account under a fictitious male name and posted photos taken covertly in their hostel’s bathroom. This campaign of harassment continued for months until the victim disclosed the situation to her family.

The victim’s father lodged a complaint with the police in March 2021, suspecting that the perpetrator was a fellow student, as the photos were taken inside the hostel’s bathroom. The police registered a case under IPC Section 507 (criminal intimidation by anonymous communication) and IT Act Section 66(C).

Justice Nirzar Desai presided over the case and noted that the woman sought to avenge a previous dispute with her roommate. He ordered the fine to be paid to the Legal Aid Society, stressing the need for accountability despite the settlement between the parties involved. The court made its decision after the accused petitioned for the dismissal of the FIR, claiming that the victim’s family had forgiven her.
