Recently, the Kerala HC stated that even if the custodial interrogation is not required or necessitated by itself, cannot be ground to grant anticipatory bail. The bench of Justice Kauser Edappagath was dealing with the second application for pre-arrest bail filed by the accused in Crime registered u/s 438 of the Code of Criminal Procedure.
