The Delhi High Court on Friday called for a response from the city police concerning a plea by Trinamool Congress MP Mahua Moitra. The plea seeks to quash an FIR filed against her for making a “derogatory” remark about NCW chief Rekha Sharma on social media. Justice Neena Bansal Krishna has given the police four weeks to submit a status report.
The FIR in question was registered under Section 79 of the Bharatiya Nyaya Sanhita (BNS), a provision dealing with acts intended to insult a woman’s modesty. This marks the first FIR filed under the BNS by the Delhi Police’s Special Cell since the law took effect on July 1.
The controversy began when Moitra commented on a video posted on the platform X, showing NCW chief Sharma at a stampede site in Hathras, Uttar Pradesh. The post, which has since been deleted, included a reference to a man holding an umbrella behind Sharma, which was deemed derogatory.

During the court proceedings, senior advocate Indira Jaising, representing Moitra, argued that they had not been provided with a copy of the FIR, prompting the police’s counsel to submit it in court.
