Consumer Commission Directs Puducherry Public Works Department to Pay Damages Over Unresolved Sewer Blockage

The Puducherry district consumer commission has ordered the territorial Public Works Department to pay Rs 15,000 to a 60-year-old resident and rectify a clogged residential drainage line that officials neglected despite multiple grievances.

In an order issued on August 28, a three-member bench consisting of President S. Mouttouvel and members A.S. Suvitha and G. Arumugam awarded the complainant Rs 10,000 for deficiency in service, mental suffering, and physical hardship, in addition to Rs 5,000 towards litigation costs.

Mandate for Inspection and Technical Remediation

The consumer forum instructed the PWD to conduct a thorough on-site inspection of the drainage network connected to the resident’s household.

Under the ruling, if engineers identify any blockage, defect, or choke point, the department must carry out all necessary corrective measures. These include desilting, line repairs, or the total replacement of damaged sewer sections to ensure the system functions smoothly and without disruption, contingent on the complainant paying any lawful civic fees.

Civic Duties Beyond Revenue Collection

Emphasising the responsibilities of public utilities, the commission ruled that an agency tasked with maintaining sewer infrastructure cannot confine its role to collecting user fees from the public. The bench stressed that authorities bear an equal duty to exercise reasonable care and respond expeditiously whenever residents submit specific reports of system failures or blockages.

The commission also highlighted that functional sewerage and drainage systems represent essential civic amenities directly tied to community sanitation, hygiene, and public health.

Although the PWD did not enter an appearance during the proceedings, the panel noted that the department’s absence did not dispense with the requirement to assess the claim on its merits. Because the authorities presented no records showing that the complaint was ever addressed or the obstruction cleared, the bench concluded that the persistent failure constituted an actionable deficiency in service.

Prolonged Inaction and Sanitary Hazards

The dispute originated on December 6, 2025, when the drainage line serving the man’s home became clogged. Represented before the bench by advocates S. Vimal and M. Dhinagaran, the complainant stated that he had paid all requisite PWD sewer charges under the applicable policy.

Following the blockage, the resident lodged a formal written grievance with the department. While officials assured him of immediate intervention, no field action was taken.

The petition stated that stagnant effluent subsequently gathered around the residential premises, generating a persistent stench and attracting swarms of mosquitoes and insects. The resulting unsanitary environment posed serious health risks and daily hardship to the household, prompting the resident to approach the consumer commission for redress.
