Chief Justice of India (CJI) B.R. Gavai on Thursday stressed the need to ensure a level playing field in arbitration between large corporations and smaller businesses, particularly micro, small and medium enterprises (MSMEs).
Speaking at the inaugural event of the Delhi Arbitration Weekend, CJI Gavai said India was steadily developing into a leading global arbitration hub, but cautioned that equitable access must remain at the heart of reforms.
“One area that requires attention is ensuring a level playing field in arbitration between larger corporations and smaller businesses, particularly micro, small, and medium enterprises. Although legislative and policy initiatives have been promising and commendable, it is essential to expedite their implementation and benefits to all stakeholders,” the CJI observed.
He underlined that arbitration should serve as a tool for commercial efficiency, resolving disputes swiftly, instead of turning into a process that prolongs conflicts.
The event was also attended by Delhi High Court Chief Justice Devendra Kumar Upadhyaya and Chief Justice of the High Court of Australia, Justice Stephen Gageler, who shared the stage with the CJI.
Legal experts view arbitration as a vital mechanism for reducing litigation burdens on courts. The CJI’s remarks are expected to give further impetus to ongoing reforms aimed at making India a preferred seat for international arbitration.
