Bombay High Court Issues Notice to CBI on Sachin Waze’s Bail Plea

The Bombay High Court on Wednesday issued a notice to the Central Bureau of Investigation (CBI) regarding a bail plea by former Assistant Police Inspector Sachin Waze. Waze is currently challenging his detention related to the corruption case against former Maharashtra Home Minister Anil Deshmukh.

Waze, who has been incarcerated for two years without a chargesheet being filed, argued that he is entitled to default bail under the existing legal provisions. His legal challenge also includes questioning the constitutionality of Section 306(4)(b) of the Criminal Procedure Code (CrPC). This section requires that a person granted a pardon in a case must remain in custody until the trial concludes, a stipulation that Waze’s legal team contends denies him the rights typically afforded to both an accused and a witness.

The bail plea was presented before a vacation bench consisting of Justices N R Borkar and Somasekhar Sundaresan. Waze’s legal representation, comprising advocates Aabad Ponda, Sajal Yadav, and Rounak Naik, highlighted that Waze had prepared his petition by hand from Taloja Central Prison. They requested that the plea be heard after the high court’s vacation period, prompting the justices to issue a notice to the prosecution.
