The Allahabad High Court on Monday put a stay on the ongoing construction of a mobile tower in Viram Khand area of Lucknow’s Gomti Nagar, following concerns raised by local residents over safety and security.
A bench of Justice Sangeeta Chandra and Justice B.R. Singh passed the order while hearing a writ petition filed by Sanjay Kumar Rai and others. The matter has been listed for the next hearing on September 23.
The petitioners contended that Sameer Saxena, the owner of house number C-2/200 in Viram Khand 2, had permitted Indus Tower Limited to erect a mobile tower on his property. Their counsel, B.K. Singh, argued before the court that the installation of the tower posed a serious threat to the safety and well-being of residents in the vicinity.

The petitioners have also challenged the constitutional validity of Rule 15(4) of the Telecommunications (Right to Way) Rules, 2024. They alleged that the provision effectively removed the requirement of obtaining a “No Objection Certificate” (NOC) from competent authorities before installing any mobile tower, thereby compromising public safeguards.
The High Court, taking note of the submissions, restrained further construction activity at the site until further orders.
