The Allahabad High Court has directed the Uttar Pradesh government to submit details of any security rules framed specifically for retired High Court judges. The direction was issued by a Division Bench comprising Justice Ajit Kumar and Justice Swarupama Chaturvedi during the hearing of a petition filed by the Association of Retired Supreme Court and High Court Judges.
The petition raises the issue of inadequate or undefined security arrangements for former judges after their retirement. Representing the association, the petitioner’s counsel stressed that the matter involved the safety of individuals who held constitutional positions, arguing that even after demitting office, retired judges deserved basic security cover to ensure their and their families’ protection.
The counsel submitted before the court:
“Minimum security even a retired judge needs to have while he moves out in public. A constitutional post holder at least deserves this much protection to his life and his family after he demits office.”
Taking note of the submission, the Bench directed the Additional Advocate General representing the state to produce any existing rules or policies governing security arrangements for retired High Court judges.
The court said:
“Let learned Additional Advocate General place relevant security rules, if any, framed for retired High Court Judges. A proper affidavit be filed in the matter by the next date fixed.”
The court has listed the matter for further hearing on February 9, 2026, directing the state to respond by then with an appropriate affidavit detailing the applicable rules, if any.
