Allahabad High Court Gives BHU Executive Council One Last Chance to Decide on Assistant Professor’s Promotion

The Allahabad High Court has given the Executive Council of Banaras Hindu University a final one-month window to take a conclusive decision on the long-pending promotion of Dr. Sushil Kumar Dubey, an assistant professor who has been waiting for implementation of a 2021 resolution recommending his advancement.

Dr. Dubey approached the court with a contempt plea, stating that he was recommended for promotion from Assistant Professor Stage-2 to Stage-3 at the Executive Council meeting on June 4, 2021. Despite the council’s decision, the resolution was never acted upon by the university administration.

While hearing the matter, Justice Manju Rani Chauhan recorded that the university had recently placed on record a fresh resolution dated October 9, 2025. In that meeting, the Executive Council decided to seek legal opinion from a senior advocate before finalising the issue and asked for a month’s time to pass final orders in line with the earlier writ court direction.

The court was not impressed with the prolonged delay. Noting that “ample time” had already been granted for reconsideration, Justice Chauhan nevertheless allowed one last extension.

The order stated that the Executive Council must take a final decision within a month, strictly in compliance with the earlier writ court ruling. The bench made it clear that failure to do so would have consequences.

“If by the next date, the final decision of the Executive Council is not placed before this Court, the Vice Chancellor, Banaras Hindu University, Varanasi, who is Ex-Officio Chairman of the Executive Council, shall remain present before this Court,” the court directed in its order dated November 12.

The matter will be taken up again on December 15, 2025.
