Allahabad High Court Denies Bail to Shivam Dubey in Bikru Massacre Case

The Allahabad High Court has rejected the bail plea of Shivam Dubey alias Dalal, an accused in the 2020 Bikru massacre case in Kanpur, where eight police personnel were killed in an ambush led by gangster Vikas Dubey.

A bench of Justice Saurabh Shyam Shamshery dismissed the bail application on August 21 after the Uttar Pradesh government opposed the plea, pointing out that the accused had attempted to mislead the court by filing a false affidavit.

The state’s counsel argued that Shivam Dubey concealed his criminal history in his affidavit by claiming that no other case was pending against him. However, a case under the Gangster Act was pending and he had even been convicted in that matter on September 5, 2023. The prosecution contended that it was impossible for the accused to be unaware of this fact, terming the concealment deliberate and misleading.

The Bikru massacre took place on the night of July 2, 2020, when a police team raided the residence of gangster Vikas Dubey in Kanpur’s Bikru village to arrest him. The team was ambushed, and eight police personnel, including Deputy Superintendent of Police Devendra Mishra, were killed.

Vikas Dubey was later killed on July 10, 2020, in an alleged encounter after he attempted to escape custody while being transported from Ujjain to Kanpur.

Shivam Dubey, described as an associate of Vikas Dubey, was arrested and lodged in jail for his alleged involvement in the massacre. The High Court, while rejecting his bail plea, noted that he could move a similar application only after a considerable passage of time.
