Allahabad HC Summons Police Commissioner Over Delayed FIR in Contempt Case

In a significant move, the Allahabad High Court has summoned Prayagraj Police Commissioner Tarun Gauba, along with other officers, to appear before the court on December 10 regarding a contempt petition. The court seeks explanations for the delay in filing an FIR following a complaint by Balram Yadav, which alleges police inaction under political pressure.

The complaint centers around a grievous incident reported at Ghurpur Police Station in Prayagraj, where Yadav claims that his father was fatally attacked by an individual linked to a local MLA on September 25. Despite the serious nature of the complaint, the FIR was not registered promptly, leading Yadav to accuse the police of succumbing to political interference, contrary to established judicial directives.

During the preliminary hearing, Justice Salil Kumar Rai expressed concerns over the police’s adherence to the court’s earlier guidelines and has scheduled a follow-up on the matter. On November 28, the involved police officials, including the Commissioner of Police and the DCP of Yamuna Nagar, Prayagraj, were present in court, submitting an affidavit stating that an FIR had been lodged and that an inquiry into the conduct of the officer responsible for the initial delay was underway.

However, the court noted the affidavit lacked specific details regarding any disciplinary action planned against the officer in question. In response, the additional advocate general representing the state sought an extension to provide a more detailed affidavit.
