Delhi High Court Allows 30-Week Pregnancy Termination for Orphaned Minor Rape Survivor

The Delhi High Court has permitted a 15-year-old rape survivor to terminate her pregnancy of more than 30 weeks, ruling that forcing a victim of sexual violence to carry a child to term and endure unwanted motherhood severely violates her fundamental right to live with dignity.

In an order issued on September 8, Justice Madhu Jain directed the medical superintendent of Lady Hardinge Medical College and S K Hospital to arrange for the procedure at the earliest, subject to medical feasibility and the girl’s physical fitness. The bench instructed the State to cover all related costs, including hospitalisation, investigations, medicines, food, and incidental needs, and directed physicians to preserve foetal tissue samples for DNA profiling in the pending criminal investigation.

Bodily Autonomy and Constitutional Rights

Under Section 3 of the Medical Termination of Pregnancy Act, terminations beyond 20 weeks and up to 24 weeks are restricted to designated categories of women who meet specific statutory criteria. However, Justice Jain observed that the expiration of this statutory timeline could not be evaluated in isolation from constitutional protections.

Exercising constitutional jurisdiction under Articles 226 and 32, the court held that the welfare, physical integrity, and reproductive choice of the minor must be accorded primary consideration. Justice Jain noted that reproductive autonomy is central to a woman’s authority over her own body, which inherently encompasses the choice of whether to enter motherhood. Compelling a survivor to carry an assault-conceived pregnancy to term risks inflicting enduring psychological and physical trauma, the bench held.

The court further observed that the petitioner, having lost both parents, faced heightened vulnerability following a heinous assault. Justice Jain affirmed that a 15-year-old child cannot be reduced to the role of a mother simply because she was forced into pregnancy through sexual violence, adding that the law must respond to such vulnerability with compassion, dignity, and protective care.

Medical Precautions and Contingency Directives

While acknowledging that advanced gestational age demands heightened medical caution, the bench ruled that clinical complexity alone could not override the survivor’s rights to bodily autonomy and personal dignity. The court mandated that all standard clinical safeguards and physical evaluations be strictly adhered to during the intervention.

The High Court also outlined instructions in the event that the foetus is born alive despite the procedure. In such a scenario, the hospital has been directed to administer all necessary medical treatment to ensure the child’s survival, after which the local Child Welfare Committee will take custody and initiate subsequent measures under applicable law.
