Adult Autonomy Overrides Parental Objections In Marriage Choices: Allahabad High Court

The Allahabad High Court has affirmed that an adult woman possesses the constitutional freedom to select her spouse and decide where she lives, ruling that parental opposition cannot supersede an individual’s personal autonomy.

Delivering the order on September 7, Justice Sandeep Jain permitted an 18-year-old woman to reside with her husband and directed law enforcement agencies to provide the couple with adequate security against any threats to their life and liberty. The court instructed police personnel to safely escort the pair to their chosen location and ensure their departure faces no disruption.

The directives were issued during proceedings on a habeas corpus petition, under which the bench had previously ordered the state and the woman’s father to produce her before the court.

Court Interaction And Findings

During a personal examination by the judge, the woman stated that she was born in 2008, making her an adult, and noted that she had completed schooling up to Class 10. She affirmed that her marriage was solemnized entirely by her own choice, free from coercion, pressure, or undue influence, and stated her intention to live with her spouse at their matrimonial residence.

The husband also appeared before the court, confirming the marriage and stating his willingness to live with her. While the woman’s father expressed grievances regarding her decision, he acknowledged before the bench that his daughter had reached adulthood.

Justice Jain noted that the woman’s testimony was clear, categorical, and consistent, finding no evidence on record or in her demeanor to suggest unlawful inducement, intimidation, or coercion behind her actions.

Constitutional Freedoms And Protection Orders

In the ruling, the court held that genuine parental concern cannot outweigh the constitutionally safeguarded liberty of a major. The bench observed that upon reaching majority, an individual has the entitlement to make independent life choices, including marriage, and relatives cannot substitute or dictate those decisions.

The judge emphasized that selecting a partner forms an integral element of personal dignity and individual liberty, which state authorities are bound to protect in accordance with the law.

Concluding that the woman could not be forced to remain in parental custody against her wishes, the court ordered that neither her family members nor anyone else may interfere with her lawful choice, intimidate her, or subject the couple to harassment.
