The Supreme Court on Monday granted a suspension of sentence to Hopeson Nignshen, a self-styled lieutenant of the National Socialist Council of Nagaland-Isak Muivah, who was serving life imprisonment for the February 2009 kidnapping and murder of three Manipur administrative officials.
A division bench comprising Justice M. M. Sundresh and Justice P. B. Varale granted the relief after taking into account that Nignshen had already undergone more than 17 years of incarceration while his appeal remains pending before the apex court. The judges ordered the suspension on the strict condition that Nignshen must remain within the territorial limits of Delhi and cannot exit the capital until his appeal is definitively decided. Counsel representing the Manipur state government opposed the suspension plea.
Legal History and Trial Transfer
Nignshen’s conviction was previously affirmed by the Delhi High Court on November 20, 2019, which upheld a 2014 trial court judgment finding him guilty of criminal conspiracy, abduction, robbery, and murder alongside other NSCN-IM operatives. In addition to the life sentence, the trial court had ordered Nignshen to pay a fine of Rs 35,000 for looting the personal property of the victims.
The case had originally been moved out of Manipur to Delhi in May 2010 pursuant to Supreme Court orders. The transfer was initiated after the Central Bureau of Investigation expressed serious apprehensions regarding threats to Nignshen’s life and the potential for widespread public unrest should court proceedings take place in Manipur.
The 2009 Kasom Khullen Abductions
According to the CBI, the incident occurred on February 13, 2009, when Nignshen and other members of the NSCN-IM intercepted and kidnapped Dr. Thingnam Kishan Singh, who was serving as the Sub-Divisional Officer and Block Development Officer of Kasom Khullen in Manipur’s Ukhrul district, along with five members of his staff.
The following day, the captors released three of the detained employees—Ram Singh Siro, Ramthing Singlai, and Kapangkhui Jajo—all of whom belonged to the Naga community. However, Dr. Kishan Singh, Y. Token Singh, and A. Rajen Sharma were executed. Their bodies were subsequently recovered from the banks of the Taphao Kuki river in the vicinity of Senapati in Manipur.
Ethnic Fallout and CBI Arrest
The discovery of the bodies provoked severe ethnic tensions between the Meitei and Naga communities, triggering widespread bandhs across Manipur. Given the gravity and public reaction surrounding the killings, the Manipur government handed the investigation over to the CBI, which arrested Nignshen on May 29, 2009.
