Madras High Court Upholds Capital Punishment In Triple Child Rape Case

The Madurai bench of the Madras High Court has confirmed the death penalty for a man convicted of raping three minor children, stating that the severity of the crime justified the execution. In a ruling delivered on June 30, the court upheld the sentence under the penetrative sexual assault provisions of the Protection of Children from Sexual Offences Act.

Justices N. Anand Venkatesh and K. K. Ramakrishnan determined that the convict was unfit to live in society after destroying the dignity of his victims. The bench classified the case under the rarest of rare category, which is legally reserved for exceptional offenses where life imprisonment is deemed insufficient.

Details of the Abuse

According to the court order, the perpetrator carried out a calculated and systematic campaign of terror against the three children inside a home environment. The judges noted that the man used death threats and fear to control the victims, forcing them to witness the physical violation of one another.

The bench emphasized that the offense went beyond physical harm, inflicting lifelong emotional trauma on the children and shattering their innocence.

Legal and Moral Responsibility

The court stated that the law must maintain an unyielding stance against individuals who exploit children. Sparing the perpetrator’s life, the judges observed, would represent misplaced mercy and signal that the safety of children is of little value compared to the comfort of a prison cell.

In the ruling, the bench clarified that confirming the death sentence was not an act of vengeance. Instead, the judges described the decision as a solemn duty to serve justice, deter potential offenders, and restore moral order, concluding that the convict had forfeited his right to live among humanity.
