Thane MACT Awards ₹21.63 Lakh Compensation to Family of Road Accident Victim

The Motor Accident Claims Tribunal (MACT) in Thane has ordered a compensation of ₹21.63 lakh to the family of a 40-year-old man who died in a road accident in 2019, holding both the dumper truck driver and the deceased partially responsible for the mishap.

Yogesh Ganpat Divekar, employed as a recovery agent with a cooperative credit society, died on July 28, 2019, when his motorcycle was hit by a speeding dumper truck in the Balkum area of Thane. The collision proved fatal on the spot.

In its order passed on Wednesday, MACT Member R.V. Mohite observed that the accident occurred due to contributory negligence. The dumper driver was found to be driving at high speed and failed to maintain control of the vehicle. At the same time, the deceased was riding his motorcycle in the middle of the road, which also contributed to the crash.

The Tribunal assessed Divekar’s notional income at ₹16,000 per month. Based on this, it awarded a total compensation of ₹21.63 lakh to his legal heirs. The amount includes loss of dependency, funeral expenses, and other statutory heads.
