The Delhi High Court on Friday declined to entertain a petition filed by Arunachal Pradesh-based environmental activist Bhanu Tatak, who challenged the government’s decision to stop her from travelling abroad for higher studies.
Justice Swarana Kanta Sharma refused to grant relief after government counsel pointed out that multiple criminal cases were pending against Tatak in Arunachal Pradesh, and that she had been restrained on the basis of a lookout circular (LOC) issued by state police.
Court’s Observations
The court held that the matter did not fall within its territorial jurisdiction and directed Tatak to approach the appropriate high court for relief. The judge noted that since the LOC was issued by the Arunachal Pradesh Police, the Delhi High Court could not intervene.

Petitioner’s Arguments
Senior advocate Colin Gonsalves, representing Tatak, argued that the restrictions violated her fundamental rights under the Constitution and described the travel ban as “arbitrary and unjustified.” He told the court that despite repeated requests, Tatak and her family had never been provided a copy of the LOC.
Tatak, 30, was scheduled to travel to Ireland on September 7 to pursue a three-month academic programme at Dublin City University. She contended that she had valid travel documents and an invitation letter, but was prevented from boarding her flight at Delhi airport.
Government’s Stand
Standing counsel Ashish Dixit, appearing for the Ministries of Home and External Affairs as well as the immigration bureau, submitted that the plea was not maintainable before the Delhi High Court. He added that the LOC had been issued in view of Tatak’s involvement in “10 to 12 cases” in Arunachal Pradesh, including allegations of inciting violence during protests and urging mobs to confront a cabinet minister.
Activism and Protests
Tatak is the legal advisor of the Siang Indigenous Farmers’ Forum, which has been at the forefront of protests against the proposed 11,500 MW Siang Upper Multipurpose Project in Arunachal Pradesh. Police officials allege that she played a leading role in mobilising violent demonstrations against the hydropower project.
