Allahabad HC Directs Food Adulteration Complainant to Approach Food Safety Department

The Allahabad High Court has directed a petitioner alleging food adulteration on the Krishna Janmabhoomi campus in Mathura to lodge a fresh complaint with the Department of Food Safety and Drug Administration in Lucknow.

Justice Prakash Padia, while disposing of the writ petition filed by Shri Krishna Janmsthan Seva Sansthan through its secretary, Kapil Kumar Sharma, instructed that the Assistant Commissioner (Food) decide the matter within six weeks of receiving the complaint.

According to the petition, Sharma had accused one Ashok Raghav of selling adulterated food on the Krishna Janmabhoomi premises. Prior representations made to the district magistrate and the Senior Superintendent of Police, Mathura, allegedly failed to yield any action.

The court noted that in light of the order it intended to pass, issuing notice to the opposite party and keeping the petition pending would serve no useful purpose. The directive allows the petitioner to seek a prompt administrative remedy rather than await prolonged judicial proceedings.
