“Judicial Duty Is Not Limited To Mere Adherence To The Law, But Must Also Incorporate Human Sensitivity”: Chhattisgarh High Court Chief Justice Ramesh Sinha

A one-day Divisional Judicial Seminar for Judicial Officers of Raipur Division was organized by the Chhattisgarh State Judicial Academy at the New Circuit House, Civil Lines, Raipur. A total of 126 judicial officers from four districts of the Raipur Division participated in this seminar. The Chief Guest, Hon’ble Mr. Justice Ramesh Sinha, Chief Justice, High Court of Chhattisgarh & Patron-in-Chief Chhattisgarh State Judicial Academy, inaugurated the session. This ceremonial moment symbolized the illumination of justice and legal wisdom. The workshop focused on subjects such as speedy disposal of cases, provisions related to arrest, remand, and bail, purpose and process of trial of the accused, and analysis and study of laws related to hindu succession and inheritance.

The seminar was also graced by the presence of Hon’ble Mr. Justice Naresh Kumar Chandravanshi, Judge High Court of Chhattisgarh, Hon’ble Mr. Justice Deepak Kumar Tiwari, Judge High Court of Chhattisgarh, & Hon’ble Mr. Justice Rakesh Mohan Pandey, Judge High Court of Chhattisgarh.

Hon’ble The Chief Justice emphasized that in light of the recent enactment of the Bharatiya Nagarik Suraksha Sanhita (BNSS) & New Laws, it is essential that judges are thoroughly familiar with its provisions, particularly those governing the principle of bail, to ensure consistency and legal accuracy in judicial decision-making. If there is any possibility of prejudice to the rights of the accused, Judges must exercise great caution regarding what is included and what is withheld. Judges may have there own views in the facts and circumstances of the case, but Judges are bound by the four corners of the law as well as the judicial pronouncements of the Hon’ble Supreme Court and the High Court. The Magistrate should be cautious while deciding a bail application, ensuring the correct mentioning of the crime number, the relevant sections under which the accused has been charged, and the accurate particulars of the accused. Any omission or incorrect detail in the above may lead to delay in the disposal of the application by the higher court, resulting in the curtailment of the accused’s personal liberty.

Addressing the judicial officers of the Raipur Division, Hon’ble The Chief Justice stated that the expectations from the judiciary have significantly increased in the present times. The public expects impartiality, efficiency, and sensitivity from us. The topics selected for discussion in this seminar are the foundational pillars of our criminal and civil jurisprudence. Competence in these areas is not just about procedural compliance, but a crucial aspect of ensuring fair justice, protecting individual liberties, and enhancing public trust in the judicial process.

Hon’ble The Chief Justice emphasized that the objective of this divisional workshop is to promote judicial excellence and foster a culture of learning, collaboration, and continuous improvement within the judicial system. He stated that the judiciary plays a foundational role in maintaining the rule of law and ensuring justice to all sections of society. As guardians of the Constitution, it is imperative that we remain not only legally sound, but also socially aware, responsive, and ethically resolute.

In his impactful address, Hon’ble The Chief Justice expressed that a trained and well-resourced judiciary is the cornerstone of public trust. He urged all judicial officers to fully benefit from the workshop, actively participate in the sessions, and apply the knowledge gained in their respective courts.

In his address, Hon’ble The Chief Justice reiterated that judicial duty is not confined to mere compliance with law, but must also involve human empathy. Behind every case file lies a human story — one of pain, struggle, and hope. “Where law is our instrument, justice is our purpose.” The Hon’ble Chief Justice wished the workshop great success and expressed hope that it would lead to constructive insights, actionable outcomes, and a renewed commitment to serve the people of this nation with fairness, humility, and dedication.

The event was attended by the Registrar General and officers of the CSJA, along with judicial officers from Raipur, Dhamtari, Balodabazar, and Mahasamund districts. The welcome address was delivered by the Principal District & Sessions Judge, Raipur, the introductory speech was presented by the Director of the Chhattisgarh State Judicial Academy, and the vote of thanks was delivered by the Chief Judicial Magistrate, Raipur.

A total of 126 Judicial Officers from Raipur/Dhamtari/Baloda Bazar/Mahasamund Districts participated, presentations were given by the participants on the subjects —

  1. Expediting Execution
  2. Provisions relating to arrest, remand and bail with reference to guidelines issued by Hon’ble Supreme Court in Satender Kumar Antil vs. CBI and Siddharth vs. State of U.P. and provisions relating to disposal of property in criminal cases
  3. Analysis of Law relating to succession and inheritance in Hindus
  4. Purpose and procedure of examination of accused under Sec 351 BNSS / 313 Cr.P.C.
