Court Orders FIR Over Viral Video Threatening Akhilesh Yadav

A local court in Gautam Buddh Nagar has directed police to register an FIR against a man who allegedly issued a death threat to Samajwadi Party (SP) national president and Kannauj MP Akhilesh Yadav through a viral social media video.

The order was passed by Second Additional Chief Judicial Magistrate Ravi Kumar Sagar on May 13, 2025, after Surajpur Kotwali police failed to act on a complaint lodged by SP leader and advocate Ramsaran Nagar. The video in question, which surfaced on April 12, shows the accused man making an open threat to shoot Akhilesh Yadav.

Ramsaran Nagar, who serves as the National Secretary of the SP Advocates’ Wing and is a former president of the Bar Association, Gautam Buddh Nagar, had approached the court on April 23 under Section 173(4) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), seeking action over the inaction of the police.

Taking note of the seriousness of the threat, the court directed the Surajpur police to register an FIR against Amrendra Pratap Singh and his associates. The judge also clarified that although the accused is a resident of Lakhimpur district, the FIR can be filed by the aggrieved party anywhere in India, since the threat was made via social media—a platform not bound by geography.

“The incident cannot be confined by territorial jurisdiction,” the court observed, further noting that if jurisdiction becomes an issue, the FIR may be treated as a Zero FIR and transferred to the concerned district in accordance with law.

Nagar’s plea emphasized that the video had caused significant public outrage and hurt sentiments. It further argued that since the video was posted on Facebook—a widely used public platform—the threat carried serious social and political consequences and should not be treated as a matter confined to any specific location.

Following the court’s direction, the Surajpur police are now obligated to formally register the FIR and initiate an investigation into the matter.
