Delhi High Court Dismisses PIL Against Ajmeri Gate Constructions as Motivated

The Delhi High Court has rejected a public interest litigation (PIL) that sought the demolition of alleged illegal constructions at Ajmeri Gate, imposing a penalty of Rs 10,000 on the petitioner for misuse of the PIL format.

Chief Justice D.K. Upadhyaya and Justice Tushar Rao Gedela, presiding over the case, characterized the petition as a “camouflage” intended for “extraneous” purposes rather than genuine public interest. The bench emphasized that such actions undermine the court’s efforts to address legitimate public concerns.

Public interest litigation has traditionally been a vital tool in India, aimed at providing a legal voice to those marginalized due to illiteracy, poverty, or other disadvantages. The court highlighted its role in safeguarding this mechanism to ensure that it serves those genuinely in need and is not exploited for personal or ulterior motives.
