The Delhi High Court issued an injunction on Friday against the use of the name “Ratan Tata National Icon Award” by a journalist planning to host the award event. The court’s decision came after the journalist, Rajat Srivastava, founder of Delhi Today Group, consented not to use the name of Ratan Tata or associate the Tata brand with the event.
Justice Mini Pushkarna ruled that the names “Tata” and “Tata Trusts” are well-known trademarks and that the name of the esteemed industrialist, Ratan Tata, must be protected from unauthorized use. The court underscored the significance of safeguarding such renowned trademarks and the identity of prominent figures like Mr. Tata to prevent any potential misuse that could harm their reputation.
During the proceedings, it was revealed that Sir Ratan Tata Trust and Tata Sons Pvt Ltd had filed a lawsuit through the law firm Anand and Anand, represented by attorneys Pravin Anand and Achuthan Sreekumar. The plaintiffs sought to prevent the unauthorized use of their registered trademarks and claimed damages exceeding Rs 2 crore for the alleged reputational harm caused by Srivastava’s planned event.
Furthermore, the court ordered Srivastava not to use any logos or images related to Ratan Tata and Tata Trusts. As a part of the court’s directive, Srivastava is required to provide a formal undertaking to this effect, with the matter scheduled for a compliance check on February 12.
