The Central Bureau of Investigation (CBI) has escalated its legal battle by appealing to the Calcutta High Court for the imposition of the death penalty on Sanjay Roy, the convict in the RG Kar hospital rape-murder case. The appeal was presented before a division bench comprising Justice Debangsu Basak and Justice Md Shabbar Rashidi, with a scheduled hearing set for January 27.
Sanjay Roy was previously sentenced by the Sealdah court on January 20 to life imprisonment until the end of his natural life. The sentence was for the heinous crime of raping and murdering a doctor on duty at the RG Kar Medical College and Hospital on August 9, 2024. However, the CBI, represented by Deputy Solicitor General Rajdeep Majumdar, argued that the sentence was inadequate given the gravity of the offense and is thus seeking the death penalty.
During the proceedings, Majumdar emphasized that the CBI, as the investigating authority, possesses the right to challenge the lower court’s sentencing on the basis of its inadequacy. Meanwhile, the West Bengal government, represented by Advocate General Kishore Dutta, has also expressed similar sentiments, arguing that the life sentence was insufficient for the nature of the crime committed.
