Delhi High Court Summons Woman to Verify Consensual Marriage Claims

In a recent development, the Delhi High Court has ordered a woman to physically appear in court to clarify the nature of her marriage to a man, amid conflicting statements about whether it was consensual. Justices Pratibha M Singh and Amit Sharma issued the directive after the woman’s video failed to switch on during a video-conferencing session, where she attempted to assert that her marriage was forcibly solemnized.

The court expressed concerns over the woman’s inconsistent statements, noting discrepancies between her claims at the police station and her recent assertions in court. “Clearly, the girl is taking contradictory stands as compared to what she has stated in the police station and what she has stated today. Let her be produced physically along with her family members on the next date of hearing,” the bench stated. The woman and her family are to be safely escorted to the court on December 16 by police officials.

The case came to light when the husband filed a habeas corpus petition after his wife was reportedly taken by her parents and became untraceable since October 24. He alleged that they married in September at a temple against her family’s wishes. Initially, both confirmed to the police that the marriage was consensual. However, subsequent events have thrown this into question as the woman later took a contradictory stand in court.

In October, the woman’s parents allegedly took her from the couple’s home under the pretext of performing some rituals, after which her phone number became unreachable. This led the husband to approach the court, concerned about his wife’s safety and the legitimacy of her current whereabouts.

The police’s status report adds another layer of complexity, indicating that the woman initially stated in a handwritten note that she voluntarily married the man. Later, a complaint was lodged on her behalf alleging that the marriage was forced.
