Supreme Court Remarks on Bail Plea: “Every Day Matters for Citizens’ Freedom”

The Supreme Court of India emphasized the importance of each day concerning a citizen’s freedom. This remark came during the hearing of a bail plea. Amandeep Singh Dhall, an accused in the Delhi liquor scam, filed the plea through his lawyer, Kapil Sibal.

The plea highlighted that the Delhi High Court has been hearing Dhall’s bail application for several months without reaching a decision. The Supreme Court, noting the significance of the matter, directed the High Court to decide on the bail plea promptly.

The plea stated that the High Court has conducted 40 hearings on Dhall’s regular bail application and has now postponed the matter to July 8. The bench, comprising Justice B.R. Gavai and Justice Sandeep Mehta, noted the delay, stating, “Despite 40 hearings, you have not been able to decide on regular bail. In matters concerning citizens’ freedom, every single day matters. The regular bail case has been pending for 11 months, infringing upon the petitioner’s freedom.”

The Supreme Court instructed the High Court to decide on the bail application before the summer break, which starts on June 3, with May 31 being the last working day. Dhall is an accused in the Delhi liquor scam, being investigated by the CBI and ED. Previously, the trial court denied Dhall’s bail, prompting him to approach the High Court.

According to investigative agencies, Dhall was involved in formulating the liquor policy and benefitting the Aam Aadmi Party. The Delhi government had implemented the liquor policy on November 17, 2021, but retracted it in September 2022 following corruption allegations.
